HOUSTON, TX – A pedestrian was killed Monday night after being struck by at least three vehicles on the North Freeway near the Greenspoint area, according to Harris County authorities.

Fox 26 reports that deputies responded around 9 p.m. to reports of a crash involving a pedestrian in the northbound lanes of Interstate 45 near Rankin Road and Greens Road, officials said.

Investigators said a man was attempting to cross the freeway when multiple vehicles hit him. The victim was pronounced dead at the scene.

Authorities said all three drivers remained at the location after the crash. Investigators do not believe speed or alcohol contributed to the incident.

The victim’s identity has not been released. Officials also said it remains unclear whether other vehicles may have struck him before deputies arrived.

Who’s to Blame for a Pedestrian Accident?

Liability in a pedestrian accident case depends on how the crash happened and whether someone failed to use reasonable care. In many cases, the driver is at fault, but blame may also be shared between multiple parties, including:

  • The Driver Who Hit the Pedestrian – A driver may be liable if they were speeding, distracted, impaired, fatigued, following traffic too closely, or ignoring signals, crosswalks, or roadway conditions.
  • Another Driver Involved in the Crash – In multi-vehicle accidents, a second or third driver may share fault if their actions helped cause the impact or made the injuries worse.
  • An Employer – If the at-fault driver was working at the time of the crash, their employer may also be liable in some situations.
  • A Vehicle Manufacturer or Repair Company – A defective brake system, faulty headlights, or poor repair work may have contributed to the collision.
  • A Government Entity – A city or other public agency may bear responsibility if poor road design, broken signals, or inadequate lighting played a part.

A close review of the facts, traffic laws, witness statements, camera footage, and vehicle data can help show who caused the collision and who may bear legal responsibility for the harm that followed.

Can Family Members File a Wrongful Death Claim After a Fatal Pedestrian Accident?

Yes, in many cases, surviving family members can file a wrongful death claim after a fatal pedestrian accident if another party caused the death through their careless or wrongful conduct. A wrongful death claim can help families pursue compensation for the losses resulting from their loved one’s death.

Under Texas law, the people who can file this claim are close family members, such as a surviving spouse, children, or parents. In some situations, the administrator of the pedestrian’s estate may also have a role in bringing the claim.

Strict filing rules and deadlines apply in Texas wrongful death cases. A lawyer can help your family understand who may bring a claim and what compensation may be available.
