How Do Claims Against Police Differ from Claims Against Individual Drivers?

Claims against a police department after a motorcycle accident follow different rules than claims against a private driver in Texas. A claim against an individual driver usually moves through the standard insurance process. You identify the at-fault driver, gather evidence to prepare your claim, and negotiate with their insurance company. If the insurer will not settle, you can file a lawsuit under the usual personal injury rules.

A claim against a police department follows the Texas Tort Claims Act, which sets limits and procedures for holding a government agency accountable. Instead of sending a simple insurance notice, you must provide a formal written claim that meets strict requirements. This notice must include the date, location, and facts of the crash, along with details about your injuries and property damage. Police departments also have liability caps that restrict the amount of compensation you may recover, even if your injuries are severe.

Another difference is the need to show that the officer was acting within the scope of their employment and that the conduct fits within the narrow situations in which the state allows claims. These added steps make the process more structured than a claim against a private driver and require careful attention to the deadlines and procedures set by state law. Working with a Houston motorcycle accident attorney to prepare your claim greatly improves your likelihood of achieving a successful outcome in complex cases like these.

How Much Time Do You Have to File a Claim Against a Police Department?

Texas gives injured riders less time to act when a police department is involved. Most cities require written notice of a claim within six months of the crash, and some have even shorter deadlines set by local rules. This notice is required before you can file a lawsuit, and missing the deadline can block your claim, even if the officer clearly caused the collision.
