BEXAR COUNTY, TX – The families of four Houston-area women killed in a November 5 collision involving an H-E-B truck have filed a wrongful death lawsuit against the grocer and multiple contractors.

KPRC reports that the lawsuit filed in Bexar County on December 23 claims H-E-B, its partner trucking companies Parkway Transit and Scrappy Trucking, and the driver of the truck bear liability for the plaintiffs’ loved ones’ deaths.

The lawsuit alleges the driver, who was hauling H-E-B goods, rear-ended the victims’ disabled car, sending it across lanes and overturning the truck. Attorneys allege the driver was speeding and distracted, and that the companies failed to train and supervise him properly.

The families are seeking over $1 million in damages and are requesting that key evidence be preserved. H-E-B said the driver worked for a third-party vendor and that it is cooperating with the investigation.

According to a contemporaneous report from KAMR in Amarillo, the victims, ages 19 to 30, were traveling together in a Nissan Altima about 10 miles south of Dalhart on US-87 when the car began moving slowly due to a flat tire. A southbound Peterbilt semi-truck struck the car from behind after reportedly failing to reduce its speed.

All four occupants of the Nissan were pronounced dead at the scene. The truck driver was hospitalized with non-life-threatening injuries.
